Echoes Terms of Service

Welcome to Echoes (“we”, “us”, “our”). By using the Echoes application (“App” or “Service”), you agree to these Terms of Service (“Terms”). Please read them carefully, as they govern your use of the Service, including the Echoes software provided for download or use on supported platforms.


1. Acceptance of Terms

By accessing, downloading, installing, or using Echoes, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein. If you do not agree, do not download, install, or use the Service.

2. Eligibility

You must be at least 13 years old to use Echoes. If you are under 18, you must have your parent or guardian’s permission to use the Service.

3. Account Registration and Usage

To use Echoes, you must create an account. You agree to:

You may register using your email or through third-party authentication providers, subject to their terms and privacy policies. We reserve the right to suspend or terminate accounts for unauthorized use, violations of these Terms, or any conduct we deem harmful to the Service or other users. Upon account termination (voluntary or due to violation), data may be permanently deleted.

4. License to Use the Service

We grant you a non-exclusive, non-transferable, revocable license to download, install, and use the Echoes software for personal, non-commercial purposes on supported platforms, subject to these Terms. This license does not grant ownership of the Service but permits limited use as specified.

5. User Content and Data

Echoes tracks your listening history and related metadata to provide the Service. You retain ownership of your data. By using Echoes, you grant us a limited license to use your data solely to operate and improve the Service.

You may choose to make your profile public, allowing other users to view your listening history and profile information. This feature is off by default and can be enabled or disabled in your account settings. Data shared with other users occurs only with your explicit consent to make it public.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Echoes, you agree to the terms outlined in the Privacy Policy.

8. Intellectual Property

The Service, including its software, source code, designs, trademarks, logos, and documentation, is the intellectual property of Echoes and its licensors, except for your own data. You may not copy, modify, distribute, or create derivative works from the Service without our written permission. This Terms does not grant you ownership of the Service but a limited license to use it as specified.

Open-Source Components

The Service incorporates open-source components licensed under their respective terms, which are not superseded by these Terms. A list of these components and their licenses is available in our Open Source Acknowledgments. If an open-source component is inadvertently omitted, its license still applies, and you may contact us for corrections. Nothing in these Terms limits your rights under applicable open-source licenses.

9. Termination

We may suspend or terminate your access to Echoes at any time, with or without notice, for conduct that violates these Terms, is harmful to other users or the Service, or for any other reason. Upon termination, you must uninstall the software and cease all use. You may delete your account at any time, and upon deletion, your personal data will be removed from our active systems, subject to our Privacy Policy. We reserve the right to permanently delete all account data after termination.

10. Disclaimers

Echoes is provided “as is” and “as available” without warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Echoes and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or in connection with your use of or inability to use the Service, including but not limited to data loss or business interruption.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States. Any disputes arising under these Terms shall be resolved exclusively in the courts of Pennsylvania, United States.

13. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated within the Service or on our official website. Continued use of Echoes after changes constitutes acceptance of the revised Terms.
